Cancellation insurance

When you book online at Cimalpes.com, we systematically offer you the option of taking out cancellation insurance. This insurance is available for all rentals less than or equal to €10,000 (including tax) per week, excluding those above this amount. This insurance applies to the cancellation or interruption of a stay. The cost of the insurance is 3% of the public rental price (all taxes included).

Terms and Conditions

Rates and Terms of Payment

To be valid, the reservation must be accompanied by all of the following:

  • A deposit equal to 25% of the rental price. By express agreement between the parties, it is agreed that this sum is paid as a deposit, and not as a down-payment.
  • The initialled and signed rental agreement.

The balance of the rental price must be paid one month before the start of the stay.

If the balance is not paid one month before the tenant's arrival date, the agency reserves the right to cancel the stay. In this case, the deposit will be returned to the tenant if the property is re-rented on the same dates at the same price.

The price must be paid in full, in a single instalment, on the day of booking if the booking is made less than or equal to one month before the start of the holiday.

All our prices are in Euros, inclusive of all taxes, and include administration fees, rent and service charges.

The lessee undertakes to take possession of the premises on the dates and at the times specified in the contract.

The keys will only be handed over after payment of the security deposit (amount depending on the type of apartment), any additional services booked and the tourist tax.

If the deposit is stipulated as "cashed" on the present contract, it must be paid at the time of the balance of the rental one month before arrival.

The rental price does not include :

  • Tourist tax (rate per day and per person, depending on property)
  • All ancillary services: airport transfers, ski equipment, ski passes and more.
  • Any bank charges are payable by the customer. (For credit card payments exceeding €5,000, bank charges of 1% of the amount collected will be invoiced).

Conditions and Formation of Contract

The agency issues a rental offer by any means, including any form of advertising.

The rental contract is only validly formed with the confirmation of the rental by the agency, which will take place within one month of payment of the deposit. If by the end of this period, the agency has not confirmed the rental, it will immediately return the deposit and the reservation will be considered null and void.

Cancellation

  • All cancellations must be notified by registered mail.
  • The date of presentation of the letter will determine the cancellation date.
  • In the event of cancellation by the hirer, the following conditions will apply:
    • From the reservation date to 61 days: the deposit is not returned to the tenant.
    • From 60 to 31 days: 75% of the stay will be billed to the renter
    • Between 30 days and the date of arrival or no-show at the beginning of the stay: 100% of the stay will be billed to the tenant.

In the event of cancellation for a justified reason, and in the event of re-rental of the said property by us, the amount paid may be refunded to the tenant who is unable to honour his contract. Any stay shortened or interrupted by the tenant will not be reimbursed.

If the agency is obliged to cancel the stay in the planned accommodation due to the actions of third parties or external circumstances, it will, if possible, provide accommodation of the same category, without any additional charge. Otherwise, the agency undertakes to reimburse all sums paid immediately.

Insurance

Cancellation insurance can be taken out for the stay. It will be subject to a supplement, the conditions of which will be sent to the client on request if necessary.

All objects or personal effects belonging to the tenant are the tenant's own responsibility.

The lessee is responsible for any damage caused to the property. The lessee must therefore take out insurance against theft, fire, glass breakage and water damage. More generally, he must insure himself for all rental risks and the furniture rented out, as well as for recourse by neighbors, and must be able to provide proof of this at the simple request of the owner or his representative. Consequently, the latter decline all responsibility for any recourse their insurance company may exercise against the lessee in the event of a claim.

Security deposit

Goods and chattels must only suffer the depreciation resulting from the normal use for which they were intended.

The security deposit is paid to cover any damage to the rented property.

The security deposit paid by the tenant will be kept until the counter-assessment carried out by the agency after the customer's departure. It may be cashed.

The security deposit must be paid at the latest when the keys to the rented property are handed over.

  • Either by credit card or by bank transfer, according to the amount indicated on the contract's special conditions.

It will be returned within a maximum of two weeks after the tenant's departure, after deduction of the cost of restoring the premises in the event of any damage.

If the security deposit is insufficient to cover the cost of damage, the tenant agrees to pay the balance on first demand.

Concierge services

A surcharge of up to 20% (on the price excluding VAT) may be added to our concierge services (cab transfers, housekeeping, etc.).

The re-invoicing by Cimalpes of services subject to a reduced rate of VAT will necessarily result in a change of VAT to the standard rate*, except for services subject to out-of-pocket expenses.

* As of January 01, 2014, the standard VAT rate is 20%.

Disbursements

Some additional services subject to a reduced VAT rate are provided as disbursements. As an intermediary, Cimalpes is mandated by its customer to purchase the product or service (ski passes, ESF ski lessons) from the company concerned at a reduced rate of VAT. This is a reimbursement of expenses on behalf of others, and the Cimalpes intermediary does not have to charge VAT on the sums reimbursed by the principal. Cimalpes does not charge a margin, and the service is purchased at the public price displayed at the service provider's checkout.

Arrival

Each tenant must report to the agency on arrival and will then be directed to the rented property.

  • Rentals start at 5.00 p.m.
  • All late arrivals, i.e. after 7:00 pm, must be notified to the agency before 12:00 pm in order to organize a late arrival.
  • The agency will not be able to organize arrivals after midnight.

Departure

  • On the day of departure, the accommodation must be vacated by 10.00 a.m., when the keys are handed over.
  • Any delayed departure will be billed at between €150/hour and €1000/hour, depending on the property rented (apartment or chalet).
  • The total amount of the end-of-stay invoice must be paid, at the latest, the day before the tenant's departure (i.e. Friday), as the agency is open from 09:00 to 19:30.
  • Any key, remote control or beeper not returned will be invoiced at purchase price.

Length of stay

The length of stay is specified in the special conditions of this contract. The tenant may not, under any circumstances, authorize himself to remain in the premises at the end of this period, unless agreed by the agency, subject to an additional charge, which will be fixed in proportion to the price of the stay.

The latter declares on his honour that he does not exercise or seek to exercise any profession in the rental business and that the premises which are the subject of the present contract are rented to him only as a temporary residence, major conditions without which the present rental would not have been agreed to.

State of the art

The inventory of fixtures and fittings, on arrival and departure, will be carried out unilaterally by the agency before the arrival and after the departure of the tenant. As this inventory of fixtures is not carried out in a contradictory manner, the tenant will have 72 hours in which to formulate any complaint. Once this period has elapsed, the rented property will be deemed to have been free of damage on arrival.

Tenant obligations

Use of premises: exclusively for seasonal furnished rental.

  1. Occupy the rented building, which is privately owned, on a bourgeois basis. The tenant undertakes to use the building only on a temporary basis. The building will under no circumstances be the tenant's principal or secondary residence, and the tenant will not carry on any professional, craft or commercial activity in it.
  2. The lessee undertakes to take possession of the rented premises in the condition in which they will be when he/she takes possession, as described in the description of the present contract.
  3. Occupy the chalet or apartment in such a way as not to cause a nuisance to the neighbors. In particular, he/she must not create any noise or other nuisance.
  4. The lessee undertakes to use the furniture and furnishings of the leased property for the purpose for which they are intended and in the premises where they are located. It is strictly forbidden to transport them outside the rented premises.
  5. Occupy the premises personally and may under no circumstances sublet them, even free of charge, nor assign his rights under the present agreement without the consent of the agency. He/she must live in the rented premises on a bourgeois basis, and may not, under any circumstances, store any furnishings therein, with the exception of linen and small items.
  6. Keep the premises in good condition during your stay.
  7. Do not bring in any animals, unless authorized by the agency, which will seek the owner's prior agreement, and for an additional fee.
  8. Notify the agency of any minor maintenance work he may have noticed.
  9. Allow any work to be carried out that is clearly urgent. If the work to be carried out is due to deterioration attributable to the tenant, it will be billed to the tenant.
  10. The tenant is responsible for the destruction or deterioration of any object made available to him as an accessory to the building, and for any damage that may be caused to the building and its installations as a result of abnormal use, in particular of electrical and heating appliances, or the blocking of toilets, washbasins, baths or sinks by objects likely to block the drains. In the event of suspicion of deterioration, the agency representative will have access to the rented property to carry out all necessary inspections.
  11. In the event of rental in a building, the lessees shall comply, as occupants of the premises, with the building's internal regulations, which they acknowledge having read.

Agency obligations

The agency undertakes to provide the property and its accessories as described in the description received at the time of reservation and to respect the obligations resulting from the present contract.

Claims

Any complaint relating to a service must be addressed to the agency within 48 hours of moving in.

If the renter waives one or more of the services included in the package, the agency will not reimburse the renter or pay any compensation.
